At Park Place Law, our lawyers offer mediation law services in Nanaimo, Vancouver Island, and surrounding areas. Mediation is a process whereby a separating couple meet with a neutral third party who facilitates a balanced settlement.
This option is being chosen more and more by separating couples because of its advantages over litigation which results in a settlement imposed by a judge. Mediating promotes cooperation and lessens animosity. Because one lawyer is tasked with the job of helping both parties reach a settlement, this process generally results in lower lawyer fees. Under the Family Law Act, a judge may order a separating couple to attend mediation.
In mediation, both parties would meet with either Brenda or Kirsten to discuss, if there are children involved, a parenting plan. Division of assets, debt, and spousal support (if required) are also addressed.
Once a mediation session is booked, we provide a kit which includes information on how to present the facts that the mediator needs to initiate the process.
When a couple comes to an agreement, we draft a Separation Agreement. Law Society rules require that each party take this agreement to his or her own lawyer for independent legal advice. The agreement is not signed in our office.
